What Are Writs and Orders for Seizure and Sale?
Legal tools that authorize creditors to recover unpaid debts through the seizure and sale of a debtor's assets
Writ of Seizure and Sale
Issued by the BC Supreme Court for judgments over $35,000. This court order grants legal authority to seize and sell assets to satisfy significant monetary judgments.
Order for Seizure and Sale
Issued by the BC Provincial Small Claims Court for judgments under $35,000. Designed for smaller claims with the same enforcement power.
Important Legal Requirement
Once obtained, these orders must be enforced by a Court Bailiff like Integrated Civil Enforcement. Creditors are not permitted to seize assets themselves. Only government-authorized bailiff companies can legally execute these court orders.
The Seizure and Sale Process
A straightforward, legally compliant 5-step process to recover your money
Obtain a Court Order
After winning your judgment, the creditor applies to the appropriate court (Supreme Court for amounts over $35,000 or Small Claims Court for amounts under $35,000) for a Writ or Order for Seizure and Sale.
Engage Integrated Civil Enforcement
Select Integrated Civil Enforcement as your Court Bailiff. A $500 deposit is required to initiate the enforcement process. We'll review your case and begin asset investigation immediately.
Locate and Seize Assets
Our Court Bailiffs act on the information you provide. Clients are responsible for supplying actionable leads such as vehicles, real estate, machinery, bank accounts, company ownership, and place of employment details. Using this information, our team conducts targeted investigations, attends the relevant locations, and seizes eligible assets in accordance with the court order.
Sale of Seized Property
Seized assets are sold through public auction or private sale to maximize value. We handle all logistics and ensure compliance with legal requirements throughout the sale process.
Debt Settlement
After covering enforcement costs and fees, all remaining proceeds from the sale are paid directly to you, the creditor, to satisfy the judgment debt.
Legal Exemptions
Certain personal assets are exempt from seizure under BC law, including necessary household goods (upto $4,000 in value), tools of the trade (up to $10,000 in value), and one primary vehicle (up to $5,000 in value). Our Court Bailiffs ensure full compliance with all legal exemptions while maximizing your recovery.
